Kuwait Parliament Blesses Conflict Of Interests' Bills

(MENAFN- Kuwait News Agency (KUNA)) KUWAIT, Dec 13 (KUNA) -- The National Assembly (parliament) on Tuesday blessed a set of bills and draft laws for conflict of interest cases, categorized as corruption, affirming that the harmed employer is entitled to file a case to the public prosecution pending legal action against the offender.
The parliament, in the first reading, approved the bill regarding the conflict of interest and proposed relevant laws, thus consolidating the approach in favor of transparency and averting such illegal cases,
The bill was voted upon with 54 ballots in favor and one against, among the 55 MPs present at the seaside Abdullah Al-Salem Hall.
An explanatory memo affirms that measures against such offensive cases are at the heart of the system of boosting transparency and combating corruption. One term notes that the offender must resolve the irregular situation within 15 days since receiving the warning notification. In the event he (or she) abstains from settling the issue, the protesting employer notifies the public prosecution or the Anti-Corruption Public Authority.
There will be no ensuing legal proceedings if the offender heeds and tackles the situation of conflicting interests.
Several provisions define penalties against offenders, whose failure to abide by the law is categorized as 'a corruption offense.'
Involved court is empowered to expropriate assets of the offender; equal in value to the irregularly gained funds, one term says,
Another stipulates that a suit and a court sentence do not become invalid with the lapse of statute of limitation. (pickup previous)
