Media reports Chinese companies investigated over mandatory pregnancy examinations

(MENAFN) A recent report from China's official Procuratorate Daily has revealed that over a dozen companies in the country are facing legal action for allegedly requiring female job applicants to undergo pregnancy tests, a practice prohibited under Chinese law. The investigation, initiated by the Tongzhou District prosecutor’s office in Nantong, Jiangsu Province, was prompted by concerns raised by local public welfare volunteers earlier this year.

According to the findings, investigators reviewed records from two major public hospitals and a medical examination center, uncovering instances where 168 women applying for jobs at 16 different companies had undergone pregnancy tests as part of their pre-employment health screenings. Despite not being officially documented requirements, these tests were reportedly requested verbally during job interviews, as indicated by the companies’ recruitment and staff insurance records.

Employers cited concerns over high maternity benefits as the rationale behind this practice, expressing reluctance to hire pregnant women due to anticipated financial burdens associated with maternity leave. The investigation highlighted at least one case where a woman who tested positive for pregnancy during her health check was allegedly denied employment as a result.

In response to these findings, prosecutors have filed lawsuits against the implicated companies, asserting that such practices violate women's rights to equal employment opportunities. This legal action underscores ongoing efforts in China to protect women's rights in the workplace and ensure compliance with labor laws aimed at preventing discriminatory practices during the hiring process.
