(MENAFN- Arab Times) KUWAIT CITY, April 10: Cancellation of the decision of Farwaniya Mosques Department affiliated to Ministry of Awqaf and Islamic Affairs to allow Dawah & Tabligh group to enter mosques is still vague due to non-submission of any clarifications by the ministry regarding the reasons behind the issuance and withdrawal of the decision for preventing this group from entering mosques, reports Al-Rai daily quoting informed sources.
They indicated about questions being raised concerning the ministry's failure represented by procedural and legal errors when dealing with this issue under parliamentary threats.
The sources explained that decision No. 462/2018 to prevent the Dawah & Tabligh group was issued and signed by the Director of Farwaniya Mosques Department Salah Al-Shilahi. However, decision No. 466/2018 to cancel the abovementioned decision was also signed by Al-Shilahi even though he was not in the country.
There is no information about the identity and position of the individual who signed on behalf of the director. They indicated the possibility of the ministry being involved in a legal impasse due to its rush and confusion in dealing with this matter out of fear of parliamentary pressures, adding that the ministry must have intended to issue the second decision to cancel the first decision under the name of Al-Shilahi because he had issued the first decision to prevent this group from entering mosques. In this regard, Professor of International Law Ali Hussain, when asked for a legal point of view related to officials signing on behalf of their bosses, stressed the need for the existence of an authorized signature or mandate signature; otherwise it is considered as forgery.
Meanwhile, preacher Khalil Al-Hamadi said signing on behalf of the boss without the knowledge of the latter is illegal in Islam as it is considered as deception and breach of trust. In addition, the sources believe the failure in crisis management has a security dimension. They explained that Ministry of Interior is striving to maintain security and stability of the country.
However, Ministry of Awqaf and Islamic Affairs at the same time is allowing a specific category to have a 'nightstay' in mosques with their possessions and with specific purposes. It does not follow up these purposes which could affect the security of the state, especially considering the security risks in the region and the painful experience of Kuwait via the bomb attack in Imam Al-Sadiq Mosque.
