PHC Orders KP Governor To Administer Oath To Newly Elected Chief Minister Sohail Afridi

The Peshawar High Court has directed Khyber Pakhtunkhwa Governor Faisal Karim Kundi to administer the oath of office to newly elected Chief Minister Sohail Afridi by 4 PM on Wednesday.

The court announced its reserved verdict on a petition seeking directives for the oath-taking ceremony of the new chief minister. The court stated that if the governor fails to administer the oath within the given time, the Speaker of the Provincial Assembly will perform the duty instead.

The hearing was conducted under the bench led by Chief Justice of the Peshawar High Court. During proceedings, the Additional Attorney General informed the court that the governor was currently on an official visit and was expected to return by 2 PM on Wednesday.

In response, the Chief Justice asked whether the governor had expressed willingness to administer the oath. The Additional Attorney General replied that the governor had summoned Ali Amin Gandapur for the approval of his resignation and had not yet taken a decision regarding the oath.

When asked again whether the governor had agreed to perform the oath-taking duty, the reply was that the governor would decide upon his return and that Aamir Javed Advocate had been appointed to present arguments on his behalf.

Advocate Aamir Javed requested the court to wait until the governor's return, assuring that the matter would be resolved once he is back. He also stated that until a new chief minister assumes office, the outgoing one will continue to manage administrative affairs.

However, the court rejected this argument, stating that such a situation would apply only if an election had not taken place; whereas, in this case, elections had been held and multiple candidates had filed nomination papers for the chief minister's post.

Governor Responds

In a statement, Governor Khyber Pakhtunkhwa Faisal Karim Kundi said,“I have never said that I won't administer the oath. I will act according to the Constitution and the law.” He added that he would reach Khyber Pakhtunkhwa today.

He further said that he had requested a plane from the Sindh Chief Minister and that his response had already been submitted to the High Court.“I will fulfill my constitutional duty,” he affirmed.
