Trial Status Of Mps, Mlas: HC Grants Centre, J & K Govt 'Last Opportunity' To File Status


(MENAFN- Kashmir Observer) Srinagar- The High Court of J&K and Ladakh has granted centre and J&K governments“last Opportunity” for apprising it of the current status of trial of former members of the legislative assembly and sitting or ex-parliamentarians in Jammu and Kashmir.

Hearing a Suo Moto Public Interest Litigation, a bench of Chief Justice Arun Palli and Justice Rajnesh Oswal passed the order after counsel for the both centre and J&K government prayed to comply with the order dated April 21.

While ordering to list the matter on August 11, the Court said that if the status report was not filed“appropriate order shall follow”.

In September 2022, the court said that thirteen former members of the legislative assembly and sitting or ex-parliamentarians are facing trial in Jammu and Kashmir.

The petition was registered Suo Moto 2021 by the court in compliance to the directions of the Supreme Court, directing for monitoring the progress of the trial of cases pending against the sitting and former legislators (MPs or MLAs). On 20 September 2021, the court arrayed concerned officials from Jammu & Kashmir and Ladakh as respondents. Subsequently it directed them to submit information regarding the number of cases pending in different subordinate courts as well as the matters pending in the High Court against the MPs or MLAs.
