India legalizes sex labor


(MENAFN) According to a three-judge Supreme Court panel led by Justice L Nageswara Rao on Thursday, Indian sex workers are “entitled to equal protection of the law.” He added, “criminal law must apply equally in all cases on the basis of age and consent.”

The court held that as long as sex workers are consenting adults, authorities may not intervene or take criminal action against them. Voluntary sex work is not illegal, and while operating a brothel is still a felony, people who work in one are not to be detained or otherwise abused during raids on such establishments.

The judges wrote, “notwithstanding the profession, every individual in this country has the right to a dignified life under Article 21 of the Constitution.” Mothers that participate in the sex trade should not be denied custody of their children, and children discovered living in a brothel or with a sex worker should not be believed to be trafficked.
