ICJ to Issue Opinion on Israel's Obligations to UN Agencies


(MENAFN) The International Court of Justice (ICJ) is set to provide an advisory opinion regarding Israel's legal duties towards United Nations (UN) agencies and other international organizations operating in the occupied West Bank and Gaza Strip.

This comes after a request was made by the UN General Assembly late last year, following Israel's legislative actions prohibiting the activities of the UN agency for Palestinian refugees (Unrwa) within Israeli territory, along with any interaction with Israeli officials.

Israel has accused Unrwa of being infiltrated by Hamas, a claim that the agency has firmly denied, maintaining its position of neutrality and impartiality.

The ICJ has also been tasked with addressing Israel's responsibility to allow the unrestricted flow of essential supplies to the Palestinian population.

The court’s panel of international judges was asked to provide clarity on two key issues highlighted in the resolution passed by the UN General Assembly in December.

The first question concerns whether Israel's ban on Unrwa constitutes a violation of UN conventions that ensure the independence of UN agencies.

The second issue involves whether Israel's limitations on aid deliveries to Gaza breach international humanitarian law, specifically its obligations as an occupying power to safeguard civilian lives.

Although the ICJ's opinion will not be legally binding, it holds considerable moral and diplomatic significance.

During the hearings in The Hague in April, Elinor Hammarskjöld, the UN’s Under-Secretary-General for Legal Affairs, emphasized that Israel, as the occupying power in both the West Bank and Gaza, is obligated to "allow and facilitate all relevant United Nations entities to carry out their activities for the benefit of the local population."
