
SIA Opposes PDP MLA's Plea To Travel Outside J & K

Srinagar- State Investigation Agency (SIA) has urged the High Court to dismiss an application filed by PDP youth president and MLA Waheed-ur-Rehman Parra seeking permission to travel outside of Jammu and Kashmir.
In its response to Parra's plea, the agency, through Additional Advocate General Mohsin S Qadri, described the application as“baseless and meritless”, citing his alleged involvement in“serious and heinous offences” linked to a 2020 terror-related case.
“It may be true that the applicant has not violated any bail condition in the last three years. However, the present application, which seeks to allow the applicant to visit outside J&K without the permission of the trial court, would jeopardize the powers of the trial court in proper supervision, conduct and monitoring of trial,” the SIA counsel said.
Parra, who was granted bail in May 2022, recently moved the High Court seeking permission to travel outside the Union Territory. The SIA, however, argued that merely being on bail does not entitle an accused to unrestricted movement, especially when“larger public interest and national security” are at stake.
“The applicant has not come with clean hands before the court and has tried to mislead it by misrepresenting facts,” the counsel said, adding that a similar petition filed by Parra in 2023 seeking identical relief was still pending adjudication.
The SIA accused Parra of suppressing material facts and attempting to“abuse the process of law.” The agency further argued that allowing such an application would amount to a“review” of the earlier bail order, which is not permissible under criminal jurisprudence.
