Bombay HC Mandates Same-Day Upload Of Orders & Judgments On CIS, Flags Strict Action For Delays


(MENAFN- KNN India) Mumbai, Apr 9 (KNN) The Bombay High Court has directed all judicial officers in Maharashtra and Goa to ensure that orders and judgments are uploaded on the Case Information System (CIS) server on the same day they are passed.

The Court stated that if any order or judgment is not uploaded within the stipulated time, the concerned officer must provide reasons for the delay. It warned that failure to comply would amount to“misconduct touching to the integrity of judicial officer.”

Mandatory Reporting and Accountability Measures

Judicial officers have also been instructed to submit a monthly certificate confirming timely uploading of orders in a prescribed format. The circular cautions that any discrepancy in the information provided may lead to suspension, with departmental enquiry being dispensed with.

Additionally, officers have been directed not to retain court files after disposal of cases.

The circular has been issued through Principal District and Sessions Judges, who have been tasked with ensuring that the directions are communicated to all judicial officers and strictly implemented.

Concerns Over Irregularities in Subordinate Courts

The latest directions stem from concerns highlighted in earlier inspections, including a communication dated January 9, 2020.

The High Court Registrar's inspection flagged multiple irregularities in subordinate courts, including deviations from prescribed court timings, delays in uploading judgments, prolonged reservation of orders, and lapses in case management.

Further irregularities in case management were also noted, with judgments often not uploaded promptly or kept reserved for extended periods. Instances were observed where evidence was not recorded despite scheduled hearings, and judicial officers left headquarters without prior intimation.

Focus on Timely Justice Delivery

The High Court directed judicial officers to strictly adhere to court timings, ensure prompt uploading of judgments, and deliver timely pronouncements of orders to address deficiencies in the judicial process.
