J&K Govt Orders Eviction From Nazool Land Over Expired Leases

(MENAFN- Kashmir Observer) Srinagar- The Jammu and Kashmir government has ordered the eviction of occupants from several properties built on Nazool, or state, land in Srinagar, citing expired leases and the absence of valid renewal or extension orders.

The properties facing eviction notices include commercial and other establishments in prime areas such as Polo View near Lal Chowk, Rajbagh and Karan Nagar.

Among those served an eviction notice is the iconic white building of the Mohi-ud-Din Trust at Polo View. The order issued by the Office of the Assistant Commissioner Nazool/Estates Officer, Srinagar, directs the Trust to vacate the premises and hand over possession by September 21.

According to the order, the Trust had earlier been served a notice on August 5 and asked to produce documentary evidence establishing its authorisation to occupy the property.

The material submitted by the Trust, however, failed to establish the existence of a subsisting lease or any order issued by the competent authority for its renewal or extension, the government said.

The Estates Officer, exercising powers under Section 5(1) of the Jammu and Kashmir Public Premises (Eviction of Unauthorised Occupants) Act, 1988, subsequently ordered the eviction of the Mohi-ud-Din Trust from the public premises.

The Trust has been directed to vacate the property and hand over peaceful possession to the Estates Officer on or before September 21.

The order further warns that failure to comply within the stipulated period would lead to action for eviction and taking over of the public premises.

Officials familiar with the matter said similar eviction notices have been issued to establishments in Rajbagh and Karan Nagar that occupy Nazool land and have allegedly defaulted on rent.

Nazool land refers to government-owned land held under lease or other authorised arrangements. The latest action comes amid efforts by the administration to address occupancy of such properties where leases have expired or rental obligations have not been met.

Across Jammu and Kashmir, more than 58,000 kanals of government land is classified as Nazool land. Of this, over 50,000 kanals are in Jammu division and more than 7,000 kanals in Kashmir division.

In Srinagar and Jammu cities, commercial establishments collectively occupy more than 5,600 kanals of Nazool land.
