US Cities, States Challenge Trump Immigration Rule in Federal Court
(MENAFN) A coalition of US cities and state governments filed separate lawsuits Monday seeking to block a new federal immigration policy that would allow authorities to consider an applicant’s use of certain public assistance programs when deciding whether to approve green cards or visas.
New York City Mayor Zohran Mamdani criticized the measure, arguing that it would not improve public safety or reduce government waste while warning of its potential impact on residents.
"Nothing about this rule will reduce waste or keep Americans safer or improve New Yorkers' lives," New York City Mayor Zohran Mamdani said, calling the measure "simply a vehicle for confusion and a vehicle for cruelty."
The municipal lawsuit was filed in the US District Court for the Southern District of New York by Chicago, San Francisco, Seattle, Santa Clara County and King County, together with the legal advocacy organization Public Rights Project.
The challenge focuses on a Department of Homeland Security regulation scheduled to take effect Friday. The rule would broaden the list of government assistance programs that immigration officials can examine when determining whether a person could become a "public charge."
Among the programs potentially considered under the expanded policy are Medicaid and the Supplemental Nutrition Assistance Program (SNAP), increasing the range of benefits that could factor into immigration decisions.
A separate lawsuit was led by New York Attorney General Letitia James and supported by 21 other states and the District of Columbia. The states argue that giving immigration authorities "sweeping discretion" to penalize people for accessing legally available public assistance could undermine public health and community stability.
The two legal challenges represent a broader effort by local and state governments to prevent the administration from implementing the expanded immigration rule, with the courts now set to consider whether the policy can take effect as scheduled.
