Belgian Teacher Fired Over Headscarf Refusal Sets Up Legal Showdown


(MENAFN) A teacher in East Flanders has been dismissed after refusing to remove her headscarf under a provincial ban on religious symbols in schools, a broadcaster reported Monday — a decision her union is now vowing to fight in court.

Hadija Amajoud had worn a headscarf since joining a provincial special education school in Assenede in 2022. The province opened disciplinary proceedings against her once she made clear she would not stop wearing it in the classroom, ultimately leading to her termination.

The ACOD trade union says it will contest the dismissal before the Chamber of Appeal in Brussels, arguing the case carries broader stakes for how religious freedom and neutrality are balanced in Belgian education.

Amajoud herself questioned the limits of an employer's authority over a teacher's personal choices, calling the province's version of neutrality "purely political." She pushed back on the very premise behind the ban: "Actually, no one is neutral. Every teacher stands in front of a class with his or her own convictions," she said.

Provincial officials defended the firing as a matter of enforcing staff rules that went through a democratic approval process. The underlying ban — which bars both students and teachers from wearing badges, symbols, or clothing signaling political or religious beliefs — has applied across all provincially run schools since the start of this school year.

The policy has already faced one legal challenge: six students and multiple organizations brought the matter before Belgium's Council of State, which sided with the province in May. Separately, the Flemish Institute for Human Rights had earlier concluded that Amajoud experienced discrimination and intimidation in connection with her case.
