Tiered Royalties Become The Majority In Biopharma Licensing As High-End Rates Rebound

New analysis from Current Partnering highlights a continued shift towards tiered royalty structures in pharmaceutical and biotechnology licensing agreements.
Analysis of more than 770 royalty-bearing licensing deals announced between January 2020 and August 2026 found that 60% of qualifying deals in 2026 use tiered royalty structures, compared with around four in ten in 2020.
The findings point to a continuing shift towards deal structures that allow licensors to participate more substantially in future commercial success as sales increase.
Higher royalty rates have also become more prominent following a comparatively subdued market in 2024. Approximately 40% of qualifying 2026 licensing deals include royalty rates of 15% or more, while the median disclosed royalty reference rate currently stands at approximately 12%.
“The most interesting development is not simply the level of royalty rates, but how the economics of licensing agreements are being structured,” said Claire Nicholson, CEO of Current Partnering.
“Tiered royalties give both sides greater flexibility in allocating future value, while our analysis also continues to show significant differences according to development stage, asset characteristics and the wider economics of the transaction.”
The analysis included in the report found a clear premium associated with more advanced assets, reinforcing the importance of using genuinely comparable transactions when assessing royalty terms rather than relying on a single industry-wide average.
Recent agreements also demonstrate that royalties extending into the twenties remain achievable in selected transactions, although headline rates need to be considered alongside sales thresholds, territories, development responsibilities, upfront payments and milestone structures.
“The royalty percentage is only one part of the economics of a licensing deal,” Nicholson added.“For dealmakers, the real value comes from understanding how comparable assets have been structured and what combination of financial terms has been achieved.”
