Trump Administration Seeks Supreme Court Approval for Mail-In Ballot Rules
(MENAFN) The Trump administration asks the US Supreme Court to restore new regulations governing mail-in ballots ahead of the November midterm elections, marking its third attempt to revive the rules.
The request challenges a preliminary injunction issued Friday by US District Judge Indira Talwani in Massachusetts. The ruling prevents the US Postal Service from enforcing regulations that require states to adopt standardized envelope designs, unique tracking barcodes and an online system for verifying ballot mailings.
The Justice Department argues that the regulations fall within the federal government’s authority over the postal system and do not interfere with states’ responsibility for administering elections.
"While the States have primary authority to regulate the manner of elections, they cannot choose to use the federal mails to carry out their elections but then insist that their election-related mail is somehow exempt from the Postal Service's rulemaking authority," the application states.
The final Postal Service regulations, issued Aug. 21, require election ballot envelopes to carry official "Election Mail" logos, designs compatible with automated processing and tracking barcodes. State election officials would also be required to enter voter names, addresses and corresponding barcodes into a federal postal database.
Mailings that fail to meet the requirements would be sent back to local election offices.
The regulations do not address who is eligible to vote, how ballots are counted or when votes must be submitted. Those matters remain under the authority of individual states.
