Utah Judge Clears Path for Trial in Charlie Kirk Murder Case


(MENAFN) A Utah judge ruled Tuesday that the case against Tyler Robinson, accused of fatally shooting conservative activist Charlie Kirk, can move forward to trial, according to a news outlet.

District Judge Tony Graf issued the ruling after a probable cause hearing in which prosecutors contended enough evidence existed to push the case toward arraignment, the news outlet reported.

Robinson, 23, is accused of firing a rifle at Kirk, 31, from a rooftop during a rally at Utah Valley University on Sept. 10, 2025. Kirk, co-founder of Turning Point USA and a close ally of President Donald Trump, was killed in the attack, which sent shockwaves through American politics.

Robinson faces a charge of aggravated murder — a first-degree felony carrying the possible death penalty — along with additional counts. He has yet to enter a plea.

Prosecutor Ryan McBride argued that Robinson's political beliefs supplied a motive for the shooting, and contended that firing a rifle into a crowd of roughly 3,000 people posed a serious danger to bystanders.

Defense attorney Richard Novak pushed back on the motive claim, arguing there was no evidence Robinson had ever discussed Kirk or voiced opinions about him beforehand. Attorney Staci Visser separately argued that an aggravating factor tied to risk to bystanders shouldn't apply, since prosecutors allege a single shot struck a single victim.

Judge Graf sided with prosecutors, allowing the aggravating factor to stand and ruling that they had met the evidentiary burden required at this preliminary stage. The decision does not resolve Robinson's ultimate guilt or innocence.

Tuesday's hearing followed an earlier presentation by prosecutors that included security footage, digital records and forensic evidence tied to the alleged killing.
