California Jury Dismisses Musk’s Lawsuit Against OpenAI CEO
(MENAFN) A US jury in California on Monday ruled against Elon Musk in his lawsuit targeting OpenAI CEO Sam Altman, bringing to a close a contentious three-week legal confrontation between the two prominent tech billionaires, according to media reports.
Musk initiated the case in 2024 against Altman and OpenAI, the developer of ChatGPT, arguing that the artificial intelligence firm broke an alleged promise to remain a nonprofit organization.
Microsoft, which began investing in OpenAI as early as 2019, was also included as a defendant. Musk alleged that the tech corporation “aided and abetted” the AI startup in its supposed violation of a charitable trust; however, the court dismissed this accusation as well.
In his complaint, Musk sought to compel OpenAI and Microsoft to relinquish up to $134 billion in what he described as “ill-gotten gains,” remove Altman along with OpenAI President Greg Brockman from their leadership roles, and reverse the company’s 2025 restructuring that expanded its for-profit division. He also maintained that any recovered funds should be directed back to an OpenAI charity rather than to himself.
Despite Musk’s arguments, the jury concluded that the lawsuit had been filed beyond the legally allowed statute of limitations, noting that Musk had a three-year window to bring the case but failed to do so within the required timeframe.
US District Judge Yvonne Gonzalez Rogers stated that “There’s a substantial amount of evidence to support the jury’s finding,” adding that she was prepared to dismiss Musk’s claims “on the spot.”
