German State Moves Toward Possible Ban on Denying Israel’s Statehood
(MENAFN) According to reports, the German state of Hesse is considering legislation that could make it a punishable offense to question Israel’s right to exist.
The proposal, led by Hesse’s Prime Minister Boris Rhein together with Justice Minister Christian Heinz, is expected to be formally presented on Thursday. The draft is also scheduled for introduction in Germany’s upper parliamentary chamber, the Bundesrat, on May 8, although detailed provisions have not yet been disclosed.
Critics argue that the planned law is intended to restrict criticism of Israel and could significantly narrow the space for public political expression.
The state’s Justice Ministry had previously pushed for the creation of a new criminal provision back in 2023, including concerns related to social media content.
Under current German law, questioning Israel’s right to exist is not a criminal offense. However, while authorities have imposed strict limits on pro-Palestinian expression in some cases, recent court rulings have emphasized that such speech is generally protected under freedom of expression.
Since October 7, 2023, when Israel launched its military campaign in the Gaza Strip, Germany has witnessed large-scale demonstrations opposing Israel’s actions in the territory.
