J & K HC Halts Charge-Sheet Move Against MLA Mehraj Malik

Srinagar– The Jammu and Kashmir High Court has restrained the police from filing a charge-sheet against Doda MLA Mehraj Malik, while allowing the investigation in the case to continue.

The case, which involves allegations under Section 356(2) (assault with intent to dishonour), Section 79 (obstructing a public servant), and Section 351(2) (use of force to deter a public servant), came up for hearing before Justice Rajesh Sekhri.

Issuing notice to the respondents, the court directed them to file objections within four weeks. The matter has been listed for further hearing on October 31, 2025.

Earlier, the Doda administration had prepared a dossier on Malik, claiming that the Aam Aadmi Party legislator had allegedly threatened government officials during Operation Sindoor - an initiative aimed at countering attempts to create communal and regional divides.

The dossier, prepared by the Senior Superintendent of Police (SSP) Doda and forwarded to the J&K Home Department by Deputy Commissioner Harvinder Singh, described Malik as a“history-sheeter” and“habitual offender.” It alleged that he had multiple FIRs registered against him across different police stations in the Union Territory for acts including forcibly locking government offices and attacking public servants verbally and physically.
