Kuwait- Six Inmates Acquitted Of Consuming, Smuggling Narcotics
(MENAFN- Arab Times) The Court of Appeals presided over by Judge Najeeb Al-Mulla cancelled the verdict of the Court of First Instance, which sentenced six inmates of Central Prison to fiveyear imprisonment with hard labor for allegedly consuming and smuggling drugs into the prison. According to the testimony of the official of the Central Prison, the prison officials had suspected some inmates of consuming narcotic pills.
After verifying the suspicions, the prison officer obtained a warrant from the Public Prosecution to refer the suspected inmates for a medical test to determine if they are consumed drugs. The report from the General Department for Criminal Evidences indicated the presence of narcotic substances in the urine samples of the suspected inmates
They were referred to the Public Prosecution for further investigations. In their defense, Lawyer Ali Al- Ali requested the court to acquit his clients, stressing that the warrant issued by the Public Prosecution was illegal because it was issued based on unjustifiable investigations. He also requested for the nullification of his clients' arrest and search, which were not recorded in the 'occurrence book'
He said the prison officer was not supposed to continue with the search after he failed to find drugs on his clients in his initial search. Lawyer Al-Ali insisted that the test report issued by the General Department for Criminal Evidences was not accurate, as presence of narcotic derivatives in urine does not necessarily mean his clients took the narcotics orally. He indicated the possibility of smell emitting from them could have been due to the closed spaces and improper ventilation in the jail
