Kuwait- Pay woman comp, car firm ordered

(MENAFN- Arab Times) KUWAIT CITY, Nov 27: The Civil Circuit of the Court of Appeals upheld the verdict issued by the Court of First Instance which obligated a car company to pay compensation to a Kuwaiti woman for a mistake committed by one of the workers of the agency's garage when changing the engine oil of her luxury vehicle. The legal counsel to the citizen Lawyer Abdullah Al-Alanda explained that his client bought her car from the company on installment basis. She later went to the garage affiliated to the car company for changing the engine oil. The mechanic placed the car on a crane but the car fell, resulting in damages to the car.

The company promised to handover a new car of the same model to his client but it did not fulfill that promise. His client complained to the consumer protection department after discovering that the company made repairs to her car without consulting her in order to hide the damages on the car. He indicated that the car was in the garage as of the date the lawsuit was filed. Lawyer Al-Alanda said the expert's report affirmed that the company is responsible for the damages caused to the car, estimating the value of damages at KD 8,000 and the damages as per the viewing item at KD 3,500. He added that the report estimated a decrease in the market value of the car by KD 1,205, leaving the final decision to be taken by the court. Lawyer Al-Alanda stressed that the company does not have the right to charge money for parking the car at its premises.
