Law Officers Call For Overhaul Of Government Litigation Management


(MENAFN- KNN India) New Delhi, Mar 2 (KNN) Senior government functionaries and law officers who attended the 'National Conference of Union Secretaries and Learned Law Officers on Efficient and Effective Management of Government Litigation' have called for reducing pendency in cases spanning from service matters to contractual disputes among others.

The conference was held on February 28, 2026, at Bharat Mandapam, New Delhi.

Focus on Reducing Avoidable Litigation

Deliberations covered four major themes: service, pension and employment matters; infrastructure, compensation and contractual disputes; fiscal, taxation and revenue cases; and regulatory, enforcement and compliance-related litigation.

Participants flagged systemic issues such as repetitive service litigation due to non-uniform legal positions, poor inter-ministerial coordination, inadequate consultation before filings, and routine appeals without policy review.

In infrastructure matters, they highlighted rising land compensation disputes, mounting interest liabilities, frequent challenges to arbitral awards, weak legal vetting of complex contracts, fragmented technical–legal coordination, and limited use of ADR and pre-litigation mediation.

Recommendations for Structural Reforms

A key emphasis of the conference was on reducing avoidable litigation and delays through stronger filtering mechanisms, improved coordination and early dispute resolution.

The conference recommended clear appeal-filtering criteria in service and other cases, nomination of designated officers in each department to coordinate litigation, and time-bound implementation of court judgments to prevent repetitive and contempt litigation.

Structured coordination with the Department of Legal Affairs and Law Officers was stressed for policy-sensitive matters to ensure consistency in the government's legal stance.

For infrastructure and contractual disputes, the conference recommended structured pre-litigation ADR, especially in land matters, and setting financial thresholds before challenging arbitral awards. It also stressed early legal vetting of high-value contract decisions and strengthening in-house dispute resolution systems to curb fresh litigation.

Discussions on fiscal, taxation and regulatory litigation highlighted the need to streamline enforcement and compliance processes so that disputes are resolved at earlier stages and unnecessary appeals are avoided.

Overall, the conference reaffirmed the Government of India's commitment to responsible and disciplined litigation, aiming to reduce avoidable cases, ensure timely filings and implementation of judgments, and enhance alternative dispute resolution mechanisms in line with the vision of Viksit Bharat@2047.

Release of Handbook on Institutional Litigation Governance

On the occasion, the Department of Legal Affairs under the Ministry of Law and Justice formally released the 'Handbook on Institutional Litigation Governance.' The handbook was released by Arjun Ram Meghwal during the conference.

The publication provides ministries and law officers with a structured framework to manage government litigation in a responsible and efficient manner. It emphasises disciplined procedures, data-informed decision-making and transparent processes to strengthen oversight and ensure consistency in legal governance across departments.
