Kuwait - Al-Otaibi accuses fellow lawyer of offending judiciary, lawyers


(MENAFN- Arab Times) KUWAIT CITY, Jan 6: Lawyer Faisal Mohammad Al-Otaibi, in his personal capacity, submitted a petition to the Public Prosecution against a lawyer of Fatwa and Legislation Department, accusing her of offending Kuwaiti judiciary and lawyers during an event held at Kuwait Bar Association. In the petition, Lawyer Al-Otaibi explained that the incident took place on Nov 25, 2019 when Al-Mahami (The Lawyer) List celebrated its victory in the association's election.


The respondent suddenly started uttering statements which he considered offensive to Kuwaiti judiciary and lawyers. She accused Chairman of Kuwait Bar Association of highhandedness by providing cover for wrongdoings of lawyers and their corrupt activities without being conscientious. He said the woman acted in that manner publicly in front of many people including some lawyers and guests who graced the occasion.


Lawyer Al-Otaibi urged the department to take legal procedures against the woman in line with Articles 209 and 210 of the penal code, reminding that he is a stakeholder in Kuwaiti judiciary as a citizen and lawyer, so he reserves the right to submit the petition.


Nafisi arrest ordered: The Criminal Court, presided over by Judge Mohammad Ghazi Al-Mutairi, ordered the arrest and arraignment of Dr Abdullah Al-Nafisi to answer to the complaints filed by Ministry of Foreign Affairs that accused him of insulting the United Arab Emirates through his posts on his Twitter account. Dr Al-Nafisi failed to appear in yesterday's court session, despite being served with a notice to appear before the court.


This prompted the judge to adjourn the case to February 2 in order for him to be arraigned after being arrested. Lawyer Adel Al-Abdul-Hadi said on his Twitter account, 'Being Dr. Abdullah Al-Nafisi's lawyer, we confirm that we were not aware of a trial session at the Criminal Court today (yesterday). We were not notified of it'.


It is worth mentioning that Ministry of Foreign Affairs lodged its complaint against Dr Al-Nafisi on Aug 20, demanding he be referred to trial and imposed maximum punishment for jeopardizing diplomatic relations between Kuwait and the United Arab Emirates. The ministry demanded that he be punished in accordance with Article 4 of 30/1970 related to foreign state security crimes.


Article 4 stipulates that, 'Those, without the government's permission, who recruit soldiers against a friendly country or carry out hostilities against a friendly country in a manner that exposes his/her country to risk of war and jeopardizes diplomatic relations between Kuwait and the friendly countries, should be jailed for not less than three years'.


The Public Prosecution charged the accused in accordance with Article 4 of Law 30/1970 in terms of foreign state security crimes, based on his Twitter messages, which included insults against the United Arab Emirates and exposed Kuwait to severing of its diplomatic relations with the United Arab Emirates.
