(MENAFN- Arab Times) KUWAIT CITY, Jan 20: The Criminal Court sentenced three Kuwaiti citizens to ten-year imprisonment for beating a taxi driver, detaining him in the diwaniya of their house and stealing KD 185 from him.
Lawyer Zaid Al-Khabbaz filed a lawsuit on the behalf of the victim, explaining that his client, on the day of the incident, had received a call from a customer with the request to drop to a specific place, and he dropped the customer to the location.
Later on the same day, he received another call asking him to come to the same spot to drop someone. When he reached the location, the first suspect came out to him and asked him to wait for some time. He went inside, and then the second suspect came out and parked his 4WD vehicle behind the taxi to block his exit.
Then both suspects forced his client into the house where they beat him. They detained him for 30 minutes before releasing him. When his client, who had sustained injuries that were later mentioned in the medical report, returned to his taxi, he discovered that cash of KD 185, which he had kept in the car, was stolen.
Lawyer Al-Khabbaz said his client then went to a hospital to receive medical report after which he went to the nearest police station to report the incident, adding that the first suspect had claimed to be a police officer. The Public Prosecution charged the first two suspects of assaulting and detaining the taxi driver and stealing his money. It charged the third suspect of participating in the crime. Lawyer Al-Khabbaz demanded a compensation worth KD 5,001 for the physical and mental damages his client sustained.
Verdict upheld, no penalty: The Court of Appeals upheld the verdict of the Court of First Instance, which refrained from imposing penalty on a Kuwaiti man wanted by law for involvement in a financial case and was arrested for the possession of hashish in Kheiran. According to the case file, the prosecution officer informed that he sighted the suspect walking on the road, so he demanded for his identification documents. The officer then realized that the man was disoriented and later found he was wanted for a civil case related to finance. He searched the suspect and found hashish in his possession for personal consumption. Lawyer for the defendant, Attorney En'am Haider, faulted the stop and search procedures carried out by the officer in violation of law. She argued further that collecting urine sample from the accused for laboratory test violated articles nine and 80 of the law on legal and penal procedures.
