(MENAFN- Arab Times) Prison, deportation overturned for expat
KUWAIT CITY, Dec 11: The Criminal Court sentenced a business mogul and former senior official of Kuwait Airways Corporation to five years in prison with hard labor, while his son and a Syrian worker in his company were given three and a half years jail term each with hard labor and KD 3,000 bail bond to suspend execution of the judgment. The sentences were passed over allegations of illegal connection of electricity to a hotel belonging to the businessman, as the Public Prosecution Department accused the defendants of falsifying official documents. Meanwhile, the court nullified a previous verdict that sentenced a Kuwaiti man to 10 years in prison with hard labor for alleged forgery and theft. The citizen was charged for stealing a phone belonging to a female investigator whom he allegedly intimidated. The court thereby sentenced the man to two years in prison with hard labor.
Verdict revoked: The Court of Cassation presided over by Judge Faisal Khuraibet revoked the verdict issued by the Court of Appeals which sentenced an expatriate, who was accused of possessing hashish, drugs and liquor, to five-year imprisonment followed by deportation. The court instead acquitted him. According to the case file, the Operations Room of Ministry of Interior had received a call about an accident. A patrol officer immediately rushed to the location to find an expatriate lying on the ground with his car door open. When he realized that the man in a disoriented state, he searched him and his car, and found five liquor bottles and a sachet of drugs. During the court session, the defense counsel Lawyer Bashar Al-Nasser stressed that the arrest and search procedures conducted on his client were illegal because he was not caught red handed. He said his client was referred to the investigator who in turn referred him to the Criminal Investigations for taking his blood and urine samples but without a warrant from the Public Prosecution, which makes the entire process and its effects illegal.
