Court acquits Kuwaiti of selling visas

KUWAIT CITY, Feb 18: The Misdemeanor Section in the Court of Appeals overturned the verdict of the Court of First Instance which fined a Kuwaiti man KD 12,000 for trading in visas. The higher court then acquitted the citizen.

Earlier, the Public Prosecution charged the legal representative of an establishment with recruiting workers from abroad but they were not given jobs upon arrival in the country and investigations revealed there were no vacancies.

The man also failed to notify the Labor Department that the workers absconded. The prosecution asked the court to punish him based on articles 138 and 141 of Private Sector Labor Law number 6/2010. The case was filed after an inspection carried out by officials of the Ministry of Social Affairs and Labor. The officials reportedly discovered that the establishment was not performing activities for which it was licensed with 110 workers registered in its file.

Woman wins rights: The Personal Status Section of the Cassation Court cancelled the verdict of the Court of Appeals that deprived a female citizen of all her financial rights related to marriage and divorce. The court instead issued irrevocable divorce and obliged the husband to pay the woman all her financial rights related to marriage and divorce. Details of the case as presented by defense lawyer, Attorney Haya Al-Saqar Al-Dowaisari, revealed the woman filed for divorce and demanded that she retains all her rights. The lawyer affirmed the woman was legally married but the husband had the habit of beating and insulting her. The husband caused material and moral damages to the woman as he stopped supporting her needs which prompted her to file the lawsuit against him. Al-Saqer affirmed the verdict of the Appeals Court mistakenly did injustice to her client as the fault was with the husband. She presented medical reports showing injuries she suffered at the hands of the husband.
