The level of human rights and civil rights violations against people with disabilities in New York under Governor Cuomo's leadership is astronomical in scope
What is occurring in New York State are egregious human rights violations and the disabled in many ways are treated as if they are not human beings worthy of protecting.— Michael CareyDELMAR, NEW YORK, UNITED STATES, October 27, 2016 /EINPresswire.com/ -- The purposeful cover-ups of thousands of crimes including staggering numbers of deaths of innocent children and adults with disabilities continue under Governor Cuomo's administration. The NYS Justice Center is a fraud and is actively covering up most physical and sexual assault crimes, cases of gross negligence and criminally negligent deaths numbering in the many thousands. Emergency actions must be swiftly taken to stop these heinous and egregious crimes and to hold those involved accountable.
The NYS Senate and Assembly Bipartisan Oversight and Investigation Committees have been requested numerous times to conduct investigations of the Justice Center and their top officials, but it appears the Governor is holding them hostage because of a potential massive pay increases. It appears that if these critical investigations begin Governor Cuomo will put an end to legislator pay increases. These committees have subpoena power and must retrieve all files regarding all reported sexual assault crimes and deaths and, specifically, look at what was and what was not done, with those reported alleged crimes and deaths. Investigations will reveal that most were purposefully never reported to local authorities.
Almost all reported sexual assault crimes and criminally negligent deaths, are never criminally investigated and never reported to County Elected District Attorneys. Almost all deaths are purposefully kept by the Justice Center from being reported to the County Medical Examiner or Coroner. All deaths of the disabled that occur in a public institution are required, by law, to be investigated by the Medical Examiner or Coroner, which they cannot do, if they are not notified of the death.
Eleven to twelve deaths of the disabled, are reported on average, every day, in New York State and it is important to compare this to the Bronx train wreck, a couple years ago, where 4 people died in one day. Immediate emergency actions were taken to protect and save further loss of innocent train commuters, but not so for the disabled. NYS has taken no emergency actions to stop or prevent the further loss of far greater numbers of innocent lives of the disabled living in known unsafe and extremely dangerous and deadly facilities and group homes.
Elected officials have the responsibility to take emergency actions to protect and save the lives of innocent children and adults with disabilities and stop these human rights violations, within their district and throughout NYS. NYS Assembly and Senate investigations must swiftly occur. Governor Cuomo's fraudulent Justice Center abuse hotline must be shut down. The normal 911 call systems must be required by law, to be called by mandated reporters so that local authorities that are in place to protect, assist and ensure justice for everyone, can also protect, assist and ensure justice for people with disabilities that are victims of crimes, in medical distress or have died. What is occurring in New York State are egregious human rights violations and the disabled in many ways are treated as if they are not human beings worthy of protecting.
Federal criminal investigations by U.S. Attorney, Preet Bharara, must also take place, due to the multiple Federal laws being violated which include public corruption, criminal conspiracy, obstruction of justice and Medicaid fraud. Both the AP News and BuzzFeed News investigative reports, totaling close to a dozen within the last year, along with numerous State documents demand swift Federal intervention. Civil rights investigations by the U.S. Department of Justice's Civil Rights division also must swiftly take place. There is wide scale discrimination in civil rights against people with disabilities where they are being treated unequally and denied their 14th Amendment equal right to equal protections of laws. The Justice Center abuse hotline is purposefully obstructing justice and keeping most reported crimes from local authorities and directly involved in ensuring that most are covered-up, these atrocities must be stopped.
It is important to remember young Jonathan Carey, who was developmentally disabled and had Autism, and only 13, when he was suffocated to death by a caregiver (Jonathan's Law). When people that are entrusted to care for our most vulnerable, violate them and commit a crime against them, they cannot continue to be protected and shielded from firing, from the abuse registry and from prosecution by Governor Cuomo's fraudulent Justice Center.
Every day that passes, approximately, 250 calls go the NYS Justice Center abuse hotline, where most disappear. There have been over 18,000 substantiated offenses by the Justice Center; yet, there have been only 300 prosecutions, most felonies plea bargained down to misdemeanors. Documents obtained through NYS FOIL law recently used in the recent AP News Investigative Report reveals that out of the over 18,000 substantiated cases in less than 3 years ''no substantiated reports received by the office of Medicaid Inspector General by the Justice Center.'' http://bigstory.ap.org/article/cf079224f7db499d8fe1bd28fade2b0c/ny-agency-has-no-record-required-referrals-abuse-cases It is required by law that substantiated cases in facilities that receive Medicaid money be reported to the Medicaid Inspector General.
